ECONOTEL CORP («Virfon») values the privacy of its customers. However, in order to provide the best level of quality to our customers in the field of telephone service over the internet, the collection of personal information is necessary. We balanced the benefits of conducting e-business while respecting our customer’s need for confidentiality with their personal data («Personal Data»). For this reason, VIRFON adheres to this privacy policy, designed to respect our customer’s need for privacy.

1. COLLECTION AND USE OF PERSONAL DATA / NOTICE

Virfon only collects personal data from its customers and prospects to insure the highest quality of services. Before entering into an End User Agreement («Agreement») with Virfon, you will be prompted to enter personal information such your name, age, e-mail address, billing address and other necessary information. Virfon use of this Personal Data includes account and billing management, information to customers and research and analysis for market optimization. Virfon may use this information for other internal purposes. Any external reporting of information based on Personal Data made by VIRFON to third parties will be conducted anonymously. Virfon may allow third-party marketing if we find such products or services to be helpful to our customers. In such a case, Virfon will not disclose any Personal Data to third parties, but will instead transmit the information directly to its customers.

2. CHOICE / OPTING-OUT PROCEDURE

Customers must provide Personal Data to VIRFON for the full duration of the Agreement. It is the duty of our customers to maintain and update their Personal Data on record. However, clients may opt-out of VIRFON’s use of Personal Data collected for marketing purposes by clicking on the appropriate link found on each electronic promotional communication, or by writing directly to VIRFON requesting to opt-out of the Personal Data collected for marketing purposes.

3. ONWARD TRANSFER OF COLLECTED DATA / NOTICE

VIRFON will not trade, sell or disclose to any third party any form of Personal Data collected without the consent of its customer except if VIRFON is required to disclose private information in compliance with a subpoena, search warrant or other legal processes.

4. SECURITY

VIRFON will take active steps to insure that all personal data is protected from loss, misuse, unauthorized access, disclosure, alteration and destruction. VIRFON uses many different technologies and security features to ensure that the privacy of Personal Data is protected. VIRFON will update policies and security features as new technologies become available.

5. INTEGRITY OF THE DATA COLLECTED / ACCESS / NOTICE

VIRFON honors requests from customers to access and update their Personal Data. As provided in the Agreement, customers are responsible for updating their Personal Data in VIRFON’s database, including valid credit card information acceptable to VIRFON. When Personal Data is updated by a customer, VIRFON will not remove the earlier version of the Personal Data from its database even after the new Personal Data has been validated.

6. ENFORCEMENT

VIRFON believes in the importance of proper enforcement measures to protect the privacy of its customers. For this reason, VIRFON insures, through operational measures, that privacy issues are handled appropriately. Upon receipt of a complaint or dispute regarding a privacy matter, VIRFON will investigate, take action and respond accordingly to our customer’s request. If corrective actions are needed to insure the protection from future non-compliance, VIRFON will promptly implement changes and update internal operating procedures.

7. THE CHILDREN’S ONLINE PRIVACY PROTECTION ACT

VIRFON’s services are not directed at children under the age of thirteen. In compliance with the Children’s Online Privacy Protection Act (COPPA), VIRFON does not solicit, collect or hold data from children under the age of thirteen. «Virfon» is a registered trademark of VIRFON Communications in the United States and other countries. Other marks which appear on this Web site may be marks of third parties that are not affiliated with VIRFON Communications. VIRFON Communications and its affiliates do not control or endorse the content of third party Web sites.

9. EMAIL SUBSCRIPTION

VIRFON Communications has included your e-mail address in a database that is only used to communicate and inform about our products and services and/or initiatives sponsored directly by us. From time to time you may receive e-mails from us. If you do not want to receive marketing or promotional e-mails from us, please include the word “Unsubscribe” in the subject once you click here. You may still receive select e-mails from us related with the monthly billing and transactions you may have with Virfon, Virfon Viajero, Virfon Corporativo or any other products and services we provide.

10. COOKIE POLICY – Use of Computer Tracking Technologies.

A. No Tracking of Personal Information. Virfon’s Web Site(s) are not set up to track, collect or distribute personal information not entered by visitors. Through web site access logs Virfon does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.

B. Use of Cookies. Virfon, or its third-party vendors, collects non-identifiable and personal information through the use of various technologies, including «cookies». A cookie is an alphanumeric identifier that a Web site can transfer to a customer’s hard drive through the customer’s browser. The cookie is then stored on the customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by Virfon or its third-party vendors. Customer can set its browser to notify the customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customers may also set its browser to turn off cookies; however, some Web sites may not then work properly.

C. Use of Web Beacon Technologies. Virfon may also use Web beacon or other technologies to better tailor its Web site(s) to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Web site, a non-identifiable notice of that visit is generated which may be processed by Virfon or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

D. Collection of Non-Identifiable Information. Virfon may collect non-identifiable information from user visits to the Virfon Web site(s) in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on Virfon Web site(s); Web site and system administration; user analysis; and business decision making. Such information is sometimes known as «clickstream data.» Virfon or its contractors may use this data to analyze trends and statistics.

E. Collection of Personal Information. Virfon collects personal identifying information from customers during a transaction. Virfon may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Virfon understand trends and patterns. This information is not reviewed at an individual level.
